These Terms and Conditions ("Terms") govern your use of the RealBite mobile application ("App") and related services provided by Shivraj Trading LLC ("Publisher", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

Your acceptance of these Terms has the same legal value as a handwritten signature. If you do not accept these Terms, you must not use RealBite.

1. Definitions

"App" or "RealBite"

The RealBite mobile application available for download on iOS devices, including all features, content, and services provided through the application.

"User"

Any individual who downloads, installs, accesses, or uses the RealBite App.

"Account"

The personal user account created by a User to access certain features of the App.

"Database"

The collection of food product information, nutritional data, ingredient lists, and health scores available through the App.

"Health Score"

The numerical rating (out of 100) assigned to food products based on their nutritional composition and ingredients.

"Premium Version"

The paid subscription service offering enhanced features and functionality within the App.

"Products"

Food items and packaged goods that can be scanned and analyzed using the App.

"Services"

All features, functions, and capabilities provided by the App, including barcode scanning, health scoring, nutritional analysis, and product recommendations.

"Store"

The Apple App Store through which the App is distributed.

"Content"

All information, data, text, images, and other materials displayed within the App.

2. Our Mission & Independence

Shivraj Trading LLC developed RealBite with a mission to promote healthier eating habits by providing users with clear, unbiased information about the food they consume. We believe everyone deserves access to transparent nutritional information to make informed dietary choices.

Our Commitment to Independence

To maintain the integrity and trustworthiness of our Services, we commit to the following principles:

• No Advertising: The RealBite App does not display any advertising. Our interface remains clean and focused solely on providing nutritional information.
• No Brand Influence: No brand, manufacturer, or food company can pay to influence the analysis, Health Score, or presentation of their products within the App.
• No Paid Promotions: We do not accept payment to promote specific products or brands. All product recommendations are based solely on nutritional merit.
• User Data Protection: We do not sell user data to third parties for commercial or marketing purposes.
• Sustainable Funding: Our operations are funded through Premium Version subscriptions, ensuring our interests remain aligned with our users rather than advertisers or food brands.

3. How the App Works

Data Sources

RealBite analyzes food products using data from multiple sources, including publicly available food databases, user contributions, and information provided by manufacturers. While we strive to maintain accurate and up-to-date information, the Publisher does not guarantee the complete reliability of the information regarding the composition of Products listed in the Database.

Health Scores

Health Scores are calculated using proprietary algorithms that evaluate nutritional content, ingredient quality, and other relevant factors. These scores are intended to provide general guidance and should not be considered medical or dietary advice. Scores may vary as our algorithms are updated and improved.

Limitations

Users acknowledge and accept that:

• Product information may contain errors or be incomplete
• Manufacturers may change product formulations without notice
• Regional variations of products may differ in composition
• The App may not recognize all products or barcodes
• Health Scores are for informational purposes only and do not constitute health advice

4. Account Creation

To access certain features of the App, you may need to create an Account. When creating an Account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your Account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your Account
• Notify us immediately of any unauthorized use of your Account

Account Restrictions

Users are prohibited from:

• Creating multiple accounts for the same individual
• Using automated systems, bots, or scripts to create accounts
• Sharing account credentials with others
• Transferring or selling accounts to third parties
• Creating accounts on behalf of others without authorization

5. User Obligations

By using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not interfere with or disrupt the App's servers or networks
• Not attempt to gain unauthorized access to any part of the App
• Not use the App to collect information about other users
• Not reproduce, distribute, or create derivative works from the App
• Not use the App for any commercial purpose without our written consent
• Comply with all applicable laws and regulations

6. Publisher Liability

Disclaimer of Warranties

THE APP AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE PUBLISHER DOES NOT GUARANTEE THE RELEVANCE, ACCURACY, OR COMPLETENESS OF THE DATA DISPLAYED ON THE APP.

We specifically disclaim any warranties regarding:

• The accuracy or completeness of product information or Health Scores
• The suitability of the App for any particular purpose
• Uninterrupted or error-free operation of the App
• The correction of any defects or errors in the App

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIVRAJ TRADING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages arising from dietary decisions made based on App information
• Any health-related consequences from using the App

Medical Disclaimer

RealBite is not a medical device and does not provide medical advice. The information provided through the App is for general informational and educational purposes only. Always consult with qualified healthcare professionals before making dietary changes, especially if you have allergies, medical conditions, or specific dietary requirements.

7. Intellectual Property

All intellectual property rights in the App, including but not limited to the software, design, graphics, logos, trademarks, and Content, are owned by or licensed to Shivraj Trading LLC. These Terms do not grant you any rights to use our intellectual property except as necessary to use the App in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its Content
• Use our trademarks or branding without written permission
• Remove any copyright or proprietary notices from the App
• Use the App's data for commercial purposes without authorization

8. Premium Version

Subscription Terms

The Premium Version is available as a subscription service through the Apple App Store. By subscribing to the Premium Version, you agree to the following:

• Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your selected plan)
• Prices are displayed in your local currency and include applicable taxes
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment is processed through your App Store account

Cancellation

You may cancel your Premium subscription at any time through your App Store account settings. Upon cancellation:

• You will retain access to Premium features until the end of your current billing period
• No refunds will be provided for partial subscription periods
• Your account will revert to the free version after the subscription expires

Refunds

Refund requests are handled by the Apple App Store in accordance with their refund policies. Please contact Apple Support for refund inquiries.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Grounds for termination may include:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that harms other users or the App
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination:

• Your right to use the App will immediately cease
• We may delete your Account and associated data
• Provisions of these Terms that should survive termination will remain in effect

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of this page
• For significant changes, we will provide notice through the App or via email
• Your continued use of the App after changes constitutes acceptance of the new Terms

We encourage you to review these Terms periodically to stay informed of any updates.

11. Dispute Resolution

Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at the email address provided below. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
